Although Russia ratified the ECHR in 1998, the implementation of the European Court of Human Rights’ norms and rulings has shown significant limitations, particularly on the issue of non-discrimination based on sexual orientation. This study begins by questioning the factors that contribute to the ECHR’s ineffectiveness in influencing Russian domestic policy. Using qualitative methods through literature review, this study utilizes a constructivist theoretical framework to analyze the role of national identity, domestic norms, and political interests in shaping Russia’s attitudes toward the European human rights regime. The analysis shows that Russia’s involvement in the ECHR is formal and strategic, without deep normative internalization. The construction of an Orthodox identity, strengthening nationalism, and a centralized political structure are the main factors limiting the ECHR’s effectiveness in providing substantive protection for the LGBT community in Russia.
Muhammad Nur Aminuddin Rachel Natania Elysia P. This article aims to analyze why Syria chose to join the CWC regime at a time of crisis, positioning the decision as a strategic state action, rather than as a consequence of normative compliance with international law. This research employs a qualitative method with a descriptive-analytical approach through a literature review of official United Nations documents, Organization for the Prohibition of Chemical Weapons (OPCW) reports, and relevant academic literature. The analysis is conducted using a neorealist perspective that views the international regime as an instrument utilized by states in an anarchic international system. The results show that Syria’s accession to the CWC functioned as a bargaining strategy to respond to coercive pressure, particularly the threat of US military intervention following the Ghouta incident, while also shifting the chemical weapons issue from the realm of the threat of force to international institutional and procedural mechanisms. Furthermore, the accession strengthened Syria’s position within the multilateral framework by leveraging Russia’s political protection in the UN Security Council. These findings confirm that the effectiveness of international regimes such as the CWC is highly dependent on the configuration of power and support of major powers, making state compliance with the regime more strategic and conditional than normative.
Agung Famungkas Adelia Reyzaki Putri Cindy Kurnia Awalia Syamil Ahmad Mudzakkir Copyright (c) 2025 International Journal of The Newest Social and Management Research https://creativecommons.org/licenses/by-nc/4.0 2025-12-31 2025-12-31 3 2 304 310 10.59693/insoma.v3i2.78
